Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Nexus application and related services (the “Platform”). Please read them carefully. By creating an account or otherwise using the Platform, you agree to be bound by these Terms.
1. Who provides the Platform, and who provides your care
The Platform is software provided by Blüm Health (“Blüm”, “we”, “us”). Blüm provides and maintains the technology only.
The healthcare organisation you registered with — for example an NHS trust or clinic (your “Organisation”) — is responsible for your care, for the people who deliver it, and for the information and services made available to you through the Platform.
Blüm is not a healthcare provider. We do not provide medical advice, deliver care, or make clinical decisions, and we are not a party to the relationship between you and your Organisation or its clinicians.
2. Definitions
- Platform — the Nexus mobile and web applications and supporting services provided by Blüm.
- Organisation — the healthcare body you are registered with, which provides your care and the Content you see.
- Content — articles, guides, forms, questionnaires, trackers, messages, and other material made available through the Platform.
- Your data — the personal and health information described in our Privacy Policy.
3. Your account
- You may need a signup code provided by your Organisation to create an account, which links your account to that Organisation. You may belong to more than one Organisation.
- You are responsible for keeping your account credentials confidential and for activity that occurs under your account.
- You must notify your Organisation immediately if you believe your account has been accessed without your authorisation.
- You must provide accurate registration information and keep it up to date.
4. Content and its accuracy — the Organisation’s responsibility
The information, guidance, forms, and other Content you see in the Platform is created, selected, configured, and published by your Organisation.
- Your Organisation is solely responsible for the Content it publishes through the Platform, including its accuracy, clinical appropriateness, completeness, currency, and lawfulness.
- Blüm provides authoring and management tools — including optional AI-assisted drafting and a review workflow — but Blüm does not author, select, verify, endorse, or take responsibility for Organisation Content. Where AI-assisted tools are used, the resulting material is subject to the Organisation’s own review and approval before publication, and remains the Organisation’s responsibility.
- Any reliance you place on Organisation Content is a matter between you and your Organisation. If you believe any Content is inaccurate or unsafe, contact your Organisation or care team.
5. Medical disclaimer and emergencies
The Platform is a tool to support communication and access to information. It is not a substitute for professional medical advice, diagnosis, or treatment, and it is not for use in emergencies.
- Always seek the advice of your physician or other qualified health provider with any questions about a medical condition.
- Messaging and community features are not monitored in real time and must not be used for urgent or emergency needs. If you have a medical emergency, call your local emergency number or contact your care provider directly.
6. Messaging, community, and user content
- Messages you send to your care team and posts you make in community features are received and moderated by your Organisation, which is responsible for monitoring, moderation, and any clinical follow-up.
- You are responsible for the content you submit. Do not post unlawful, abusive, misleading, or confidential third-party information.
- You grant your Organisation and Blüm the limited rights needed to store, display, and process your submissions for the purpose of operating the Platform and delivering your care.
7. Acceptable use
You agree not to:
- use the Platform other than for its intended purpose of managing your healthcare information and communicating with your care team;
- attempt to access accounts, data, or areas you are not authorised to access;
- disrupt, probe, or compromise the security or integrity of the Platform;
- upload malicious code or unlawful material; or
- misuse the Platform in any way that could harm Blüm, your Organisation, or other users.
8. Intellectual property
The Platform, its software, and its design are owned by Blüm and its licensors. Organisation Content is owned by or licensed to your Organisation. Nothing in these Terms transfers ownership of the Platform to you or your Organisation.
9. Availability and changes to the service
We work to keep the Platform available and secure, but we provide it “as is” and “as available”. We do not warrant that it will be uninterrupted, error-free, or free from delays, and we may suspend access for maintenance, security, or operational reasons. We may add, change, or remove features over time.
10. Limitation of liability
To the fullest extent permitted by law:
- Blüm is not responsible for: Organisation Content; the acts, omissions, decisions, or clinical care of any Organisation or its staff; or the relationship between you and your Organisation.
- Blüm is not liable for any loss arising from your reliance on Content, from use of the Platform for urgent or emergency needs, or from matters outside our reasonable control.
- Blüm’s total liability to you in connection with the Platform is limited to the maximum extent permitted by law.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited — including liability for death or personal injury caused by negligence, or for fraud.
11. Privacy
Your use of the Platform is also governed by our Privacy Policy. As explained there, your Organisation is the data controller for your personal and health data and Blüm acts as its data processor.
12. Termination
Your Organisation may suspend or end your access at any time, including where you breach these Terms or where your relationship with the Organisation changes. You may stop using the Platform at any time.
13. Changes to these Terms
We may update these Terms from time to time. Where changes are material, we will take reasonable steps to make them available to you. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where mandatory local law provides otherwise. (To be confirmed by Blüm’s legal counsel.)

These Terms are a draft prepared for review. They must be reviewed and approved by Blüm’s legal counsel, and bracketed items completed, before they are relied upon.
